Subscription Terms of Service
1. General provisions
These Terms of Service (“Terms”) govern your (“User” or “you/your”) access to and use of Tracktiq (the “Service”). By registering for or using the Service you agree to be bound by these Terms.
The Service is provided by Blue Banana Software (“Service Provider” or “we”).
The Service is an extension of the Tracktiq application (“Tracktiq app”), which you can download from the Mac App Store. You need an active version of this application to access the Service.
2. Subscriptions
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”), either monthly or annually, depending on the plan you select.
At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or the Service Provider cancels it.
All purchases in the app are managed by Apple Inc. (“Apple”). No customer data is shared with the Service Provider by Apple. Your purchase is made through your stored App Store payment method, and you can manage your subscription or request refunds using the App Store’s billing management at apps.apple.com/account/subscriptions.
3. Free trial
The Service Provider may, at its sole discretion, offer a Subscription with a free trial for a limited time (“Free Trial”), or a free usage tier for an unlimited time.
You may be required to enter billing information to sign up for the Free Trial. If you do, you will not be charged until the Free Trial has expired. On the last day of the Free Trial period, unless you cancel your Subscription, you will be automatically charged the applicable Subscription fees for the plan you selected.
The Service Provider may modify or cancel a Free Trial offer at any time without notice.
4. Fee changes
The Service Provider may modify Subscription fees at any time. Any change becomes effective at the end of the current Billing Cycle.
You will receive reasonable prior notice of any change to give you an opportunity to terminate your Subscription before the change takes effect. Continued use of the Service after the change constitutes agreement to the modified fee.
5. Refunds
Except when required by law, paid Subscription fees are non-refundable.
6. Termination of service
The Service Provider may terminate the Service at any time. Before doing so, we will notify Users four (4) weeks in advance through public communication channels (website, social media).
7. Personal information and privacy
The Service does not collect personal data or data that can identify you as an individual. The Service may collect anonymized data for failure analysis and improving the Service. You give us permission to collect this anonymized data and maintain redundant backups. This permission extends to trusted third parties we work with to provide the Service.
How we collect and use data is explained in our Privacy Policy, which forms an integral part of these Terms.

9. Applicable law and jurisdiction
These Terms and any disputes arising from or relating to their interpretation are governed by Italian law, excluding conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. For all disputes arising out of or related to these Terms, the sole place of jurisdiction is the relevant court in Florence, Italy.
10. Terms changes
We may update these Terms from time to time. The current version is available at /terms.
11. Warranty and limitation of liability
While we work to keep the Service up and running, unexpected technical malfunctions can occur. The Service may be disconnected or limited for maintenance or to resolve malfunctions. The Service Provider is not obliged to offer non-stop access to the Service and does not warrant uninterrupted availability.
Except for bodily harm, intentional damage, or gross negligence, the Service Provider is not liable for any direct, indirect, incidental, special, exemplary, or consequential damages arising in any way out of the use of the Service.
You need internet access to use the Service. It is your responsibility to ensure access. The Service Provider is not liable for any network malfunction or performance failure by your access provider.
12. Miscellaneous
These Terms in their current version constitute the entire agreement governing use of the Service.
All notifications to the Service Provider must be sent in writing to the current address disclosed on the Service’s website; email is sufficient.
If any provision of these Terms is held unenforceable, it shall be reformed only to the extent necessary to make it enforceable. Any failure of the Service Provider to act with respect to a breach does not constitute a waiver and shall not limit rights with respect to that or subsequent breaches.
